On October 14, 2017, California Governor Jerry Brown signed the law AB 434. A new Government Code section 11546.7 is created within the law.

It requires state agencies and entities biennially post a signed form that their website complies with WCAG 2.0 Level AA.

State agencies are required to comply with Section 508, beginning from January 1, 2017. Agencies and entities must ensure compliance while developing, procuring, maintaining, or using electronic or information technology. They have to improve accessibility and increase the employment of individuals with disabilities.

The Director of Technology will create a standard form for each state agency or entity’s chief information officer. He can use the form to determine whether their website complies with the accessibility standards.

With this legislation, California joins state and municipal entities in other parts of the country. Those that have similar web accessibility requirements for governmental entities and contractors.

This legislation fills a void the Department of Justice has decided for the time being not to fill. The DOJ has put its pending regulations that set accessibility standards for state and local websites on the inactive list.

What is California Government Code Section 11546.7?

  • It requires the director of each state agency or entity, shall post a signed certification on their website. The certification confirms that the agency’s website complies with Section 7405, 11135, and WCAG 2.0 Level AA guidelines. 
  • The Director of Technology will create a standard form for each state agency or entity’s chief information officer. He can use the form to determine whether their website complies with the accessibility standards.
